Regulamin Systemu Rezerwacji Miejsc Parkingowych
Aplikacja – oprogramowanie komputerowe dostępne poprzez sieć internet, umożliwiająca Użytkownikowi korzystanie z Usług, bez konieczności jej instalowania na urządzeniu przenośnym, za pośrednictwem której Użytkownik uzyskuje dostęp do Usług.
Bilet – elektroniczne potwierdzenie dokonania rezerwacji Miejsca Parkingowego lub zawarcia umowy najmu Miejsca Parkingowego na Parkingu.
Miejsce Parkingowe – miejsce na Parkingu obsługiwanym przez APCOA, objętym usługą Aplikacji, którego dotyczy sesja parkowania realizowana i opłacana przez Użytkownika na zasadach określonych w niniejszym Regulaminie, na które zostaje zawarta umowa najmu miejsca parkingowego zgodnie z regulaminem Parkingu którego dotyczy sesja parkowania.
Infrastruktura Operatora – urządzenia i oprogramowanie stanowiące własność APCOA lub właściciela Parkingu, służące m.in. do automatycznego odczytu numerów tablic rejestracyjnych Pojazdu przy wjeździe na Parking i na wyjeździe z Parkingu oraz przekazywania powyższych danych do infrastruktury APCOA funkcjonującej w ramach Aplikacji; dane te mogą być również przekazywane do Partnerów, z którymi APCOA współpracuje w związku z Usługą; Infrastruktura Operatora umożliwia Użytkownikowi, na podstawie danych przekazanych Operatorowi w ramach korzystania Użytkownika z Usług, bezgotówkowe Parkowanie.
Karta – karta płatnicza Użytkownika obsługiwana przez APCOA w ramach metod płatności dostępnych w zakresie kanałów dostępu, których administratorem jest APCOA.
Parking – płatny obszar zlokalizowany w obrębie którego dostępne są Miejsca Parkingowe co do których może być zawarta umowa najmu Miejsca Parkingowego w zamian za wniesienie Opłaty zgodnie z regulaminem Parkingu.
Operator – podmiot zarządzający Infrastrukturą Operatora, może być to APCOA lub podmiot działający w jego imieniu i na jego rzecz;
Opłata – opłata należna APCOA od Użytkownika tytułem zawarcia umowy najmu Miejsca Parkingowego uiszczana przez Użytkownika na rzecz APCOA za pośrednictwem metod płatności udostępnionych w Aplikacji, której kwotę lub sposób jej ustalenia określa niniejszy Regulamin oraz cennik danego Parkingu udostępniony w Aplikacji. W przypadku wnoszenia opłat za Parkowanie za pomocą Aplikacji może zostać doliczona Opłata Transakcyjna.
Opłata Transakcyjna – dodatkowa opłata wynikająca z kosztów obsługi płatności oraz procesowania transakcji parkingowych przez Infrastrukturę Operatora, którą APCOA może pobierać i doliczać do Opłaty. W razie pobierania Opłaty Transakcyjnej informacja w tym zakresie umieszczona jest przed dokonaniem Opłaty.
Partner – podmiot współpracujący z APCOA w celu realizacji Usług, może być to również właściciel lub podmiot zarządzający Parkingiem.
Pojazd – pojazd samochodowy zdefiniowany w Aplikacji poprzez podanie jego pełnego numeru rejestracyjnego.
Parkowanie – umowa najmu Miejsca Parkingowego w ramach Usługi i z wykorzystaniem Infrastruktury Operatora, za zawarcie której Użytkownik dokonuje Opłaty za pośrednictwem Aplikacji; Parkowanie następuje bez pobierania biletu przy wjeździe na Parking i uiszczania należności za Miejsce Parkingowe w urządzeniach systemu parkingowego zainstalowanych na Parkingu w celu poboru Opłat z wydaniem biletu papierowego.
Regulamin – niniejszy regulamin APCOA określający prawa i obowiązki Użytkownika i APCOA w związku ze świadczeniem Usług.
APCOA – APCOA Polska Sp. z o.o. (poprzednio APCOA Parking Polska Sp. z o.o.) z siedzibą w Warszawie, Rondo ONZ 1, kod pocztowy 00-124.
Konto Użytkownika – indywidualne konto zakładane przez Użytkownika w Aplikacji pozwalające na Parkowanie z wykorzystaniem Aplikacji i korzystanie z Usług, tworzone po akceptacji niniejszego Regulaminu, umożliwiające Użytkownikowi korzystanie z Usług na zasadach wskazanych w Regulaminie.
Usługi – usługi elektroniczne świadczone Użytkownikowi przez APCOA za pośrednictwem Aplikacji, obejmujące rezerwację Miejsc Parkingowego na określony czas w określonym terminie, zawarcie umowy najmu Miejsca Parkingowego, uzyskanie informacji o ofercie Parkowania, w tym cenie oraz dokonanie płatności za Parkowanie, a także przyjmowanie zamówień na wystawienie faktur z tytułu sprzedaży oraz wystawianie faktur, przeglądanie treści zawartych w Aplikacji, w tym treści reklamowych.
Użytkownik – osoba fizyczna, osoba prawna lub jednostka organizacyjna nie posiadająca osobowości prawnej, posiadająca pełną zdolność do czynności prawnych, korzystająca z Usług za pośrednictwem Aplikacji.
